The Value of the Stolen Property Will Impact Your Charges
While the penalties you face will depend on the specific circumstances of your case, it\’s important to understand the criminal classification for the alleged crime. Depending on the value of the property stolen, you may be liable for jail time, community service, and/or fines.
The value of the property stolen, or subject to an attempted theft, will play a large factor in the severity of the criminal classification of your theft case in particular. We\’ve outlined the various levels of criminal classification, based on the value of the offense, below.
- Less than $50: Class C Misdemeanor, which can carry up to $500 in fines, but does not result in any jail time in most cases.
- Between $50 and $500: Class B Misdemeanor, which carries up to 180 days in jail and up to $2,000 in fines.
- Between $500 and $1,500: Class A Misdemeanor, which carries up to 1 years in jail and fines of up to $4,000.
- Between $1,500 and $20,000: State Jail Felony, which carries up to 2 years in state jail and up to $10,000 in fines.
- Between $20,000 and $100,000: Third Degree Felony, which carries up to 10 years in prison and up to $10,000 in fines.
For amounts that exceed $100,000, you\’ll likely face a 1st or 2nd Degree Felony, depending on the specifics of your case and the type of property stolen. If there are any aggravating factors involved in your case, such as a weapon or threats used during the crime, you could be facing additional or increased penalties.
