When is expunction the right step for my case?
Understanding whether or not expunction is the best option for your case starts with defining the process. Unlike a non-disclosure, expungement completely eliminates your criminal record, essentially wiping it clean. All files associated with your charges or arrest will be destroyed. If you believe expunction is right for your case, you must then determine if you are eligible.
In order to request an expunction of your record, you must meet one of the following:
- You were arrested but never officially charged
- Your criminal charges were dismissed
- You were acquitted by the Criminal Court of Appeals
- The offense was a qualifying misdemeanor juvenile
- You were arrested for a crime but another individual was convicted instead
- The offense was a minor alcohol-related offense
- You were given a governor’s pardon or U.S. president’s pardon
Each situation will be reviewed on a case by case basis, with eligibility alone not guaranteeing expungement. Furthermore, individuals who received deferred adjudication or probation will not qualify for expunction of their records.
