Fighting Probation Revocation
Our main goal is to keep you on probation, and out jail. When a defendant is granted probation in Texas, they’ll be walking on shaky ground. Almost any infraction of the law can net the revocation of your probation or “community supervision”, which will result in your re-arrest, and imprisonment.
The main responsibility of the probationer is to adhere to all of the terms of the probation agreement. If the probationer has a history of reporting on-time, and keeping to the terms of the agreement, it may be easier to prevent probation revocation. Otherwise, the defendant will be “violated”, or considered to have “violated the terms” of their probation.
Violating Probationary Terms
If you’ve violated the terms of your probation you may be immediately jailed, or simply asked to reappear in court to face the judge. Your fate will largely depend on the severity and frequency of the violations, and the severity of the originating criminal offense(s).
In other instances, the Harris County District Attorney’s Office may proceed with a motion to revoke probation, or a motion to adjudicate (in cases involving deferred adjudication).
With Attorney Joseph Gagliardi on your side, you’ll have a fighting chance of remaining on community supervision, regardless of the situation. If you don’t have a lawyer on your side, you’ll be at the mercy of the court. In Texas, especially Harris County, being at the mercy of the court is a bad idea.
Common Reasons for Probation Revocation
- Not reporting to your assigned probation facility/officer in a timely fashion, or at all.
- Failing drug screenings.
- Being charged with a new criminal offense.
- Violating other terms;
- such as avoiding felons,
- nightclubs,
- and former hangouts.
- Not paying restitution fees, or other fees.
