However, the standard applies to defendants who have clearly taken an action which is known to be dangerous to human life, in a reckless fashion, resulting in the killing of another person.

A good example is Intoxicated Manslaughter charges. While killing a person in a car accident isn’t necessarily illegal, the reckless act of drunk driving resulting in a car accident can be considered preventable or “reckless”, leading to liability for criminal negligence, or manslaughter charges.

In addition, prosecutors don’t need to prove murderous intent to secure a conviction. They only need to prove that the act causing the death was reckless.
