Understanding Murder Charges
Texas law defines murder as an action taken by a person who has the intent or knowledge that death will result, an action that intends to cause serious physical harm to an individual due to an act known to be dangerous to human life, in which loss of life occurs.
Texas murder charges also apply if the suspect attempts to, or commits, a non-related felony offense, or flight from the scene thereof, and causes the death of an individual.
The first two examples are direct acts of murders, while the former is an example of Felony Murder Doctrine.
The Felony Murder Rule
Felony murder doctrine is the concept of charging a person with murder if they have killed someone by committing an act dangerous to human life, or serious physical injury, regardless of their intent, during the commission of another felonious criminal offense.
The felony murder doctrine also applies if the defendant was “with” someone who unintentionally killed someone during the coarse of an unrelated felony.
Criminal Penalty if Convicted: Murder is a 1st Degree Felony in the state of Texas that carries penalty of anywhere from 5 to 99 years – life in prison.
Enhanced Murder Charges
An enhanced murder charge (Capital Murder) applies if a child, handicapped, elderly, or person that was not able to defend themselves, were killed. Enhanced murder charges also apply if a public servant was killed.
