What is Identity Theft?
Identity theft, more commonly known as ID theft takes place when an individual steals and illegally uses another individual’s personal identifying information without the consent of the person being victimized.

Identity Theft in Texas
Under the Texas Penal Code $ 32.51, an individual commits identity theft when he/she possess, obtains, transfers or uses another individuals personal identifying information without the individual’s knowledge and consent. The person committing identity theft must have the intention to harm or defraud.
In the state of Texas, identity theft is categorized as a state jail felony. In Texas, if convicted of a state jail felony, the sentence will be more than 180 days but less than 2 years in jail, along with a possible fine that will not exceed the amount of $10,000.
Depending on the amount of personal identifying objects the individual had, the state jail felony can be increased to a felony of the first degree; which is punishable by a 5-99 year prison sentence with a possible fine of $10,000.
